Welcome to www.servidoc.com (the "Site"), a website where you can obtain health certificates online (the "Service"). The Service is provided by ServiDocPR LLC d/b/a ServiDoc ("ServiDocPR" or "We", "Us", "Our"), including all information and tools available on the Site.
This document contains the Terms of Use (the "Terms") that govern your relationship with Us while using our Site and Service. By visiting or purchasing from this Site, you agree to these Terms, so please read them carefully, as they will determine how you can use the Site and Service, how we are (and are not) responsible to you, what responsibilities fall on you and us, and other key obligations, subject to each term and obligation being valid in Puerto Rico.
By using our Site and Service, you agree to these Terms. That is, before you start using the Site, please take a moment and read these Terms carefully. If you have any questions, please write to us! If you do not agree with any particular provision or term, STOP and cease using the Site immediately. We want you to feel comfortable using our Site, but we can only do so when both you and we agree to the terms that will govern your use of the Site and the Service.
We reserve the right to edit and change these Terms from time to time. Each time we do so, we will post the updated Terms on our Site, which will be effective as of the date of posting. If, after the updated Terms are posted, you continue to use the Site, you will have accepted the new Terms.
By using this Site, you will provide us with certain personal information, which we will use in accordance with our Privacy Policy. It is very important that you read our Privacy Policy, which is a separate document, so you understand how we use, manage, and share your information and activity on the Site.
To use the Service, you must create an account ("Account"), through which you will provide us with your name, credentials, email address, and payment method. When you create your Account to use this Site, you will select a username and password. You are responsible for maintaining the confidentiality of your Account username and password, for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your Account username and password. Once you create your Account, you will be able to submit additional information about yourself to request any of the certificates we offer.
By agreeing to our Terms, you agree that you are of legal age in your state of residence. If you are under eighteen (18) years of age (but never under sixteen (16) years of age), you may only use Our Site with the express consent or authorization of a parent or guardian. Therefore, if you are under the age of majority in your state, by using this Site, you agree that you have obtained the express consent or authorization, or are using this Site with the involvement of your parent or guardian.
We reserve the right, in our sole discretion and without prior notice, to deny access to and use of the Site or Service to any person for any or no reason, including, but not limited to, breach of any representation, warranty, or covenant contained in these Terms, or of any applicable law or regulation.
We will do our best to ensure that you have the best possible experience when visiting Our Site and using Our Service. However, the Internet (and the providers that keep us connected) may occasionally experience delays, downtime, or interruptions. Therefore, you acknowledge that, although the Internet is generally a secure environment, there are sometimes interruptions in the Service or events that are beyond Our control, and that We will not be liable for data lost during transmission of information over the Internet. Although We aim to make the Site accessible 24 hours a day, 7 days a week, the Site may be unavailable from time to time for any reason, including, but not limited to, routine maintenance. You understand and acknowledge that, due to circumstances both within and beyond Our control, access to the Site may be interrupted, suspended, or terminated from time to time.
We reserve the exclusive right, at any time, to change or discontinue any aspect or feature of the Site, including, but not limited to, the content, hours of availability, and the equipment necessary for access or use. In addition, we may stop disseminating any information or category of information, change or eliminate any transmission method, and change transmission speeds or other signal characteristics.
When you visit this Site and/or send emails to us, you are communicating with us electronically and therefore consent to receive communications from us electronically, including by email or by posting notices on this Site. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Through our website, you may request various health certificates and licenses ("Certificates"), which will be issued by our physicians, who are duly authorized to practice medicine in the Commonwealth of Puerto Rico ("Physician"). To request any of our Certificates, you must provide the requested medical and personal information, which will be reviewed by our Physicians. If they have any questions, they will send you an email through your Account, or alternatively, and at the Physician's sole discretion, they may request a phone call or video conference to confirm any information required for your Certificate.
To request a Certificate, you represent and warrant that all information you provide is accurate, both when creating your Account and when requesting a Certificate. You represent and warrant that you will use each Certificate for the requested purposes (for example, a Certificate for school admission cannot be used for any other purpose). ServiDocPR will not be liable for any claim or legal action resulting from your providing us with false or inaccurate information.
If you are requesting a Certificate on behalf of a minor, you will represent and warrant that you have legal guardianship over said minor prior to making such request and that the information provided about said minor is accurate. Likewise, if you are requesting a Certificate on behalf of someone other than yourself, you will represent and warrant that you have legal guardianship over said person prior to making such request and that the information provided about said person is accurate.
IN ACCORDANCE WITH THE PRIVACY POLICY AND THESE TERMS, YOU AGREE TO SEND US ANY MEDICAL OR PERSONAL INFORMATION THAT IS NECESSARY TO ISSUE THE CERTIFICATE, AND ACKNOWLEDGE AND AGREE THAT YOU ARE PROHIBITED FROM MAKING A REQUEST FOR A CERTIFICATE FOR ANYONE OTHER THAN YOURSELF, YOUR SON/DAUGHTER FOR WHOM YOU HAVE PARENTAL GUARDIANSHIP, OR THE PERSON WHOSE LEGAL GUARDIANSHIP YOU HAVE.
Our Site, both in its components and in its entirety, its logos and trademarks (“Marks”), images, text, video, audio, software, content and arrangement thereof (“ServiDocPR Content”), is protected by applicable copyright and trademark law (as applicable). We grant you a limited, non-exclusive, non-sublicensable, revocable, and non-transferable license to (i) download and use the Site on your personal device(s); and (ii) access and view any ServiDocPR Content available on or through the Site and accessible to you, solely for your personal, non-commercial use. You will not remove, alter, or obscure any copyright, trademark, or other proprietary rights notices incorporated in or accompanying the Site or the ServiDocPR Content. You will not use, copy, adapt, modify, prepare derivative works from, distribute, license, sell, transfer, publicly display, publicly perform, transmit, or otherwise exploit the Site or ServiDocPR Content. You are not granted any licenses or rights, by implication or otherwise, under any intellectual property rights owned or controlled by Us or Our licensors, except for the licenses and rights expressly granted in these Terms.
In order for you to share Our Site via links, you are granted a limited, nonexclusive right to create a text link to the Site, provided that such link does not portray Us or the Service in a false, misleading, derogatory, or defamatory manner and provided that the linking site does not contain any adult or illegal material or any material that is offensive or objectionable. This limited right may be revoked at any time. You may not use Our Trademarks to link to the Service or establish a link in such a manner as to suggest any form of association, approval, or endorsement on our part without Our express written permission. Further, you may not use, frame, or utilize framing techniques to enclose any of Our trademarks, ServiDocPR Content, other proprietary information, including the images found at the Service, the content of any text, or the layout/arrangement of any page or form contained on a page of the Service or Site without Our express written consent. Except as provided above, you are not granted any right or license by implication, estoppel, or otherwise in or under any patent, trademark, copyright, or other proprietary right of ServiDocPR or any third party.
By using our Service and/or Site, you may be exposed to third-party content ("Third Party Content"), either on our Service or through links to third-party websites. We do not control, endorse, or adopt any Third Party Content and will have no responsibility or liability for Third Party Content, including, but not limited to, material that may be misleading, incomplete, erroneous, offensive, indecent, or objectionable. You must evaluate, and bear all risks associated with, Third Party Content, including, but not limited to, other users of Our Services.
IF YOU USE OUR SITE AND/OR SERVICE, YOU DO SO AT YOUR OWN RISK. OUR SITE, SERVICE, AND THE PRODUCTS (THE CERTIFICATES) OFFERED ON THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS OF THE SITE OR THE PRODUCTS OFFERED ON THE SITE FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT WITH RESPECT TO THE SITE AND THE SERVICE, INCLUDING THE INFORMATION, CONTENT, AND MATERIALS CONTAINED THEREIN. SERVIDOCPR DOES NOT WARRANT THAT THIS SITE, ITS SERVERS, OR EMAILS SENT FROM SERVIMEDS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. IF YOU ACCESS OR TRANSMIT ANY CONTENT, INCLUDING YOUR PERSONAL INFORMATION, THROUGH THE USE OF OUR SITE OR SERVICE, YOU DO SO AT YOUR OWN DISCRETION AND RISK. YOU ARE SOLELY RESPONSIBLE FOR ANY LOSS OR DAMAGE THAT RESULTS FROM SUCH ACCESS OR TRANSMISSION; THEREFORE, YOU SHOULD USE INDUSTRY-RECOGNIZED SOFTWARE TO DETECT AND DISINFECT VIRUSES FROM ANY DOWNLOAD.
Certificates issued by SERVIDOCPR are based on information provided by you, and as such, you are solely responsible if such information is incorrect. We are not responsible for the actions or decisions taken by the person or entity that receives or evaluates the certificate. SERVIDOCPR will not refund any payment made by you if the process for which you requested the certificate is unsuccessful.
SUBJECT TO APPLICABLE LAW, IN NO EVENT SHALL SERVIDOCPR OR OUR DIRECTORS, MEMBERS, SHAREHOLDERS, OFFICERS, AFFILIATES, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, THE PRODUCTS OFFERED ON THE SITE, OR THROUGH THE SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. BY AGREEING TO THESE TERMS, YOU EXPRESSLY AND UNEQUIVOCALLY WAIVE ANY CLAIM, DEMAND, OR ANY OTHER EQUIVALENT LEGAL RELIEF AGAINST US FOR ANY DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THIS SITE OR THROUGH THE SERVICE.
NO DATA, INFORMATION, OR ADVICE OBTAINED BY YOU, WHETHER ORAL OR WRITTEN, FROM US OR THROUGH OUR SITE OR SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
WE WILL NOT BE LIABLE FOR ANY FAILURE OR DELAY IN OPERATION UNDER THESE TERMS, WHETHER OR NOT SUCH FAILURE OR DELAY IS DUE TO CAUSES BEYOND OUR CONTROL SUCH AS, BUT NOT LIMITED TO, POWER, INTERNET, OR COMMUNICATION INTERRUPTIONS, FIRES, FLOODS, EARTHQUAKES, TORNADOES, HURRICANES, WARS, PANDEMICS, ACTS OF GOD, FORCE MAJEURE, OR THE OCCURRENCE OF ANY OTHER CONTINGENCY OR UNFORESEEN EVENT BEYOND SERVIDOCPR'S CONTROL.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU OR ANY THIRD PARTY IN ANY MATTER ARISING FROM OR RELATING TO OUR SITE, THE SERVICES, OR THESE TERMS EXCEED THE SUM OF ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. THEREFORE, SOME OF THE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.
You will defend, indemnify, and hold harmless ServiDocPR (and each of our officers, directors, members, shareholders, employees, agents, and affiliates) from and against any and all claims, demands, actions, damages, losses, judgments, costs, or expenses, including, without limitation, reasonable attorneys' fees and costs, arising out of or related to (a) your use of Our Site and/or Service; (b) your violation of these Terms; (c) your violation of any rights of another; and/or (d) your conduct in connection with the Site and/or Service. If you are obligated to indemnify us, we will have the right, in our sole discretion, to control any such action or proceeding and determine whether and on what terms we wish to resolve it.
We will always work in good faith with our users to resolve any controversy or issue that may arise in the most constructive and efficient manner for all parties. However, if we are unable to resolve a dispute to your satisfaction, then you and ServiDocPR agree to arbitrate any dispute arising out of these Terms or related to the Services, except that you and ServiDocPR are not required to arbitrate any dispute in which either party seeks equitable or other relief for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets, or patents. SUBJECT TO ANY RIGHTS YOU MAY HAVE UNDER APPLICABLE LAW, ARBITRATION PREVENTS YOU FROM SUE IN COURT OR HAVE A JURY TRIAL. You and ServiDocPR agree that you will notify each other of any dispute within thirty (30) days of its arising, that you will attempt informal resolution prior to any demand for arbitration, that any arbitration will occur in San Juan, Puerto Rico, and that the arbitration will be conducted confidentially by a single arbitrator in accordance with the Rules of the American Arbitration Association, excluding any rules or procedures governing or permitting class actions. These Terms will be exclusively construed and governed by the laws of the Commonwealth of Puerto Rico without regard to its conflict of law provisions or the laws of any other state or country or your state or country of actual residence. You and ServiDocPR also agree that the state or federal courts in the Commonwealth of Puerto Rico will have exclusive jurisdiction over any appeals of an arbitration award and over any claims between the parties that are not subject to arbitration. With the exception of class actions discussed below, the arbitrator has the authority to grant any remedy that would otherwise be available in court. IF THE DISPUTE IS HEARD IN ARBITRATION OR IN COURT, YOU AND SERVIDOCPR WILL NOT COMMENCE AGAINST EACH OTHER A CLASS LAWSUIT, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE ACTION OR PROCEEDING.
You have the right to opt out of and not be bound by the arbitration and class action waiver provisions set forth above by sending written notice of your decision to opt out to the following address: ayuda@servidocpr.com The notice must be sent within thirty (30) days of your initial use of the Site, otherwise, you will be bound to arbitrate disputes in accordance with the aforementioned Terms. If you opt out of these arbitration provisions, we will also not be bound by them.

We reserve the right, at any time and without prior notice, to disable access to your account and/or cancel any ServiDocPR Certificate orders and/or terminate your account for any violation of these Terms.
You may not assign any of your rights or obligations under these Terms without our prior written consent. We may assign any or all of our rights under these Terms, in whole or in part, without obtaining your consent or approval.
These Terms contain the entire agreement and supersede all prior agreements between the parties with respect to this subject matter.
Our failure or delay in exercising any right, power or privilege under these Terms will not operate as a waiver of them.
The invalidity or unenforceability of any of these Terms will not affect the validity or enforceability of any of these Terms, all of which will remain in full force and effect. Section headings are for convenience only and should not be used to limit or interpret such sections.
These Terms will govern the relationship between ServiDocPR and its users, with the exception of any specific clause, obligation, or condition that is legally unenforceable in your jurisdiction.
